In a western Oklahoma courtroom four months ago, lawyers from two state agencies argued over who should take custody of a dangerous criminal defendant who isn't competent to stand trial and cannot be rehabilitated.
The case highlights a gap in Oklahoma's criminal justice system that raises constitutional questions about how a state should handle suspects with an irreversible traumatic brain injury.
Russell Don Ables, 47, of Elk City was charged with violating protective orders, making harassing or threatening phone calls and resisting a police officer.
